CNN —Former Trump adviser Steve Bannon should begin serving a four-month prison sentence now that a federal appeals court has upheld his contempt-of-Congress conviction, the Justice Department told a federal judge Tuesday. US District Judge Carl Nichols, who presided over Bannon’s trial, had paused Bannon’s sentence while an appeal of his conviction played out. He has given Bannon until Thursday to respond to the DOJ’s request. Circuit rejected defendant’s appeal on all grounds, including the primary argument on appeal: the requisite mental state required for a contempt of Congress violation,” the Justice Department wrote. The timing of when Bannon will be expected to report to prison is still unclear.

CNN —Donald Trump will make his most concentrated effort yet to turn his criminal trial into a political asset in the next two days, heading from the courtroom to the campaign trail and back again. Not surprisingly, a majority of Democrats feel that Trump is being treated more leniently than others, while a majority of Republicans think the opposite. But there’s also a risk Trump’s loose tongue out on the trail could get him into trouble following his alleged violations of Merchan’s gag order. They were also tied in Pennsylvania, a third swing state Biden flipped from Trump four years ago. CNN —As the first criminal prosecution of a former American president began just 13% nationwide feel Donald Trump is being treated the same as other criminal defendants, a new CNN poll conducted by SSRS finds. Most of the country was divided over whether he is being treated more harshly (34%) or more leniently (34%) than other defendants. Most Democrats and Democratic-leaning independents say Trump is being treated more leniently than other defendants by the criminal justice system (61%), while Republicans and Republican-leaning independents largely say he’s being treated more harshly than others (67%). A broad majority of Democratic-aligned Americans say Trump’s behavior during the trial thus far has been inappropriate (72%), though Republicans haven’t leapt to his defense. Only 46% of Republicans and Republican-leaning independents say Trump’s conduct has been appropriate, with 15% saying it’s been inappropriate and 39% that they haven’t heard enough to say.

Prosecutors in Michigan, Georgia and Nevada also have brought criminal charges against some of the people who signed on as fake electors in those states. A grand jury empaneled in Maricopa County, Arizona, to investigate efforts to overturn the 2020 election results in the state met this week before Mayes announced the charges. The fake electors for Trump convened at the state Republican Party headquarters in Phoenix on December 14, 2020. But in the weeks that followed, some of the fake electors continued to push for Pence to reject the legitimate Democratic slate of electors.
